1. Parties and business customers
The provider is Kevin Gerock – Prooflode, sole proprietor, Strausberger Platz 7, 10243 Berlin, Germany, trading as Prooflode.
These terms apply to customers acting for a business or professional activity. We may request evidence of business status and reject a consumer order. A business-purpose declaration alone does not remove statutory consumer rights where they apply.
2. What you purchase
Prooflode provides a fixed-scope AI Launch Repair Pilot for B2B software and technical products.
The project examines how an agreed product, launch, category expansion or repositioning is represented in selected AI-assisted buying answers and in the public sources that contribute to those answers.
Unless otherwise stated in the accepted project scope, the pilot includes:
- review of up to five agreed public customer pages;
- twelve agreed buyer questions, sampled twice using the documented search-enabled OpenAI methodology;
- review of three agreed competitor homepages and relevant returned sources;
- a source and claim map identifying material positioning, evidence or interpretation gaps;
- three human-reviewed, implementation-ready page-edit packages;
- implementation and verification instructions; and
- one repeat of the documented buyer questions after the agreed changes have been published.
The page-edit packages may include proposed copy, structural changes, claim clarification, supporting evidence requirements, internal linking or other page-level recommendations where relevant.
The customer remains responsible for deciding whether to publish the proposed changes and for implementing them on its own website.
Prooflode does not publish to your CMS unless separately agreed.
We do not provide a consumer ranking dashboard and do not promise rankings, citations, mentions, recommendations, traffic, leads, sales or revenue.
AI providers, search engines and other external platforms control their own outputs and may change them at any time. Prooflode is independent of those providers.
3. Scope acceptance, price and start
An initial fit check, evidence snapshot or discussion is nonbinding and does not constitute a purchase.
After the scope is accepted, the customer provides the information reasonably required to perform the project.
The standard AI Launch Repair Pilot is priced at €1,490 net plus applicable VAT, unless a different written scope or price is agreed before purchase.
Tax and the payable total are shown before payment or stated on the applicable invoice or order confirmation.
There is no recurring charge or automatic renewal unless separately agreed in writing.
The project starts after:
- the scope has been accepted;
- required inputs have been provided; and
- payment has been confirmed, unless otherwise agreed.
The expected delivery date is confirmed in the project communication or order confirmation.
If required information is missing, a material scope issue appears, or an external dependency prevents timely completion, we notify the customer and agree a revised delivery date rather than silently extending the project.
4. Your inputs and permitted use
You must have authority to submit and use all material provided to Prooflode and must provide accurate product facts, claims and agreed URLs.
Do not submit personal, confidential, sensitive or infringing material unless its use has been expressly agreed and is necessary for the project.
The customer is responsible for the accuracy, legality and substantiation of its own product claims.
Public source content and AI-generated output may be inaccurate, incomplete or outdated. Prooflode reviews proposed edits with reasonable professional care, but the customer remains responsible for final publication and factual approval.
After payment, the customer may use, edit and implement Prooflode's original project deliverables for its own business and the agreed product or brand.
The customer may share those deliverables with employees, contractors, agencies or advisers working on its behalf.
This does not transfer third-party rights or guarantee exclusive rights in AI-generated or generally available language.
Unless separately agreed, the project deliverables may not be resold as a standalone Prooflode service or represented as independently created proprietary research by another provider.
Source attributions, review notes and material measurement limitations should be preserved where reasonably necessary to understand the findings.
Do not present individual API samples or AI outputs as statistically representative consumer-platform rankings or as guaranteed future platform behavior.
Prooflode may not use the customer's name, logo, project or results as public proof, a testimonial or a case study without separate permission.
5. AI measurements and repeat checks
AI-assisted answers are observations made at a specific point in time under a specific technical and query context.
Results may vary because of changes to:
- models;
- search indexes;
- source availability;
- provider policies;
- geographic or account context;
- query wording; or
- other external platform behavior.
A documented answer therefore represents an observed result, not a permanent ranking or guaranteed market position.
Where a post-publication repeat is included, Prooflode repeats the agreed buyer questions using a reasonably comparable methodology after the customer confirms that the relevant changes have been published.
Unless otherwise agreed, the customer must request or enable the included repeat within 30 days after publication and no later than 90 days after initial delivery.
If the customer does not publish the proposed changes, Prooflode is not required to keep the project open indefinitely. The initial analysis and page-edit packages remain the delivered service.
A repeat check does not guarantee that an AI provider will change its answer.
6. Corrections, cancellation and refunds
If the delivered scope is incomplete or contains an error, contact support within seven days of initial delivery with a consolidated description.
We will correct an established defect within the agreed scope without an additional fee.
One consolidated correction round is included unless otherwise stated in the accepted scope.
New pages, products, markets, languages, buyer questions or materially different positioning are additional scope and may require a separate agreement.
You may cancel before substantive project work starts for a full refund.
If Prooflode cannot fulfill the agreed scope or cannot meet an agreed revised delivery date, the customer may cancel the undelivered portion of the work and receive a corresponding refund.
For a partially delivered project, any retained amount must correspond to documented, usable work actually delivered and cannot exceed the amount paid.
A refund will not be refused merely because an external AI provider produced an unexpected or unchanged answer.
Conversely, an unchanged AI answer after implementation does not by itself mean that Prooflode failed to provide the agreed analysis and editorial work.
Refunds are returned to the original payment method where reasonably possible. Processing time depends on the payment provider.
Disputed or refunded projects may be paused while the matter is reviewed.
7. Responsibility and liability
Prooflode performs the agreed analysis, measurement and editorial work with reasonable professional care.
External AI systems, search engines, websites and other third-party platforms control their own outputs and may modify or discontinue them without notice.
Prooflode cannot guarantee:
- future AI behavior;
- inclusion in AI-generated recommendations;
- citation or mention frequency;
- rankings;
- traffic;
- leads;
- conversions; or
- commercial results.
Recommendations are based on the information and public evidence reasonably available during the project.
The customer remains responsible for business decisions, final claims, publication and legal review of its own website and marketing material.
These terms do not exclude liability for intentional wrongdoing, gross negligence, injury to life, body or health, or any other liability that cannot legally be excluded.
Statutory rules apply to other liability. No blanket liability waiver is imposed.
8. Invoices, privacy and contact
Invoices are issued electronically.
You agree to PDF invoices where applicable law permits this; a PDF invoice is not represented as a structured German electronic invoice where a structured format is legally required.
Required billing information is collected before or during purchase.
Contact us before payment if your organisation has specific procurement or invoice requirements.
Personal information is handled as described in the applicable legal and privacy notice.
Optional marketing is not part of this contract.
